Abstracts FROM GENERAL CONDITIONS OF SALE

Any placement of an order via the Website presumes prior consultation and acceptance in full of the full General Conditions of Brussels Watch, available on the Website. These abstracts only include the most important provisions.

Article 1 - The Buyer. In order to be able to validly place an order via the Website, the Buyer must be at least 18 years of age and have legal capacity or hold a parental authorisation that allows the Buyer to place an order via the Website. When the Buyer submits to BWC, via the Website, details necessary for delivery of the Product(s) offered on the Website, the Buyer must ensure the accuracy and completeness of the information provided. In the event of an error in the Buyer's details, BWC may not be held responsible for any impossibility to deliver the ordered Product(s).

Article 2 - Products. The photographs and descriptions of the Products are indicative only and are not contractually binding. BWC may not be held liable for any errors or omissions in the presentation of the Products. BWC shall honour orders placed by the Buyer while supplies last.

Article 3 - Orders. When placing an order, the Buyer expressly acknowledges that doing so implies a payment obligation. Orders may be placed in French, German or English. When an order is complete, a summary of the order and a copy of the General Conditions shall be sent by email to the Buyer, to the email address indicated by the latter, for the Buyer's records. The order is also archived by BWC. Once payment has been made, the Buyer shall receive an email from BWC acknowledging receipt of and summarising the order. This message shall be sent to the email address indicated by the Buyer.

Article 4 - Unavailability. If, despite BWC's best efforts, one or more Products ordered by the Buyer are temporarily or permanently unavailable or if the delivery time will exceed eight (8) days from the date indicated upon acceptance of the order (except in the case of force majeure), BWC shall inform the Buyer accordingly by email. The Buyer will then have the possibility to modify or cancel the order at order@armogan.com. In the event of a delay in delivery, the Buyer must indicate his or her intention to cancel or modify the order no later than fifteen (15) calendar days after having been informed of the delay by BWC. If applicable, BWC undertakes to reimburse any payment already made as soon as possible and in any case no later than twenty-five (25) days from the date of payment. No additional compensation shall be due or paid by BWC to the Buyer.

Article 5 - Prices. The prices for the Products indicated on the Website are expressed in euros (€), dollars ($) or pounds (£), including all taxes and delivery costs. Customs duties or other duties that may not reasonably be calculated in advance may be charged to the Buyer. The cost of returning the Product(s) in the event an order is retracted shall be borne by the Buyer (see Article 10 below).

Article 6 - Payment. The total amount due for the order is indicated to the Buyer on the Web page summarising its "shopping basket", i.e. all items in the order. Before proceeding to payment, the Buyer thus has the possibility to verify the details of the order and the total price and to correct any possible errors. Payment is due when placing an order. Payment may be made by bank transfer, bank (credit) card or PayPal only. Online payment is completely secure. Payment constitutes the last step in validation of an order. The Buyer may modify an order at any time, until payment is made. Upon confirmation of payment by the Buyer, the order is validated and becomes final, without prejudice to the right of retraction provided for by Article 10 below. The Buyer shall receive an email from BWC acknowledging receipt and summarising the details of the order. This message shall be sent to the email address indicated by the Buyer.

Article 7 - Title. The Products remain the sole property of BWC until payment in full of all invoices, including taxes and other expenses.

Article 8 - Delivery. Orders shall be delivered to the delivery address indicated by the Buyer when placing the order. Delivery times will vary, depending on the delivery country selected by the Buyer and the time at which the order is placed. The Buyer may track at all times the package online using the number and link provided by email after placement of the order. BWC cannot be held responsible if the breach or improper fulfilment of its own obligations is attributable to a third party or to an unforeseeable and insurmountable act or to an event of force majeure.

Article 9 - Delivery times. Unless an exception applies, delivery shall occur within eight (8) days from 9.00 am (GMT+1) on the day following the placement of an order, for orders placed by the Buyer Monday through Friday.

Article 10 - Returns and the right of retraction. The Buyer benefits from a statutory retraction period of forty-five (45) clear days from the date of receipt of the order, without having to provide a justification. To obtain reimbursement for a Product exchanged for another size or Product (while supplies last), the Buyer must return, at his or her expense, the Product, unused and in its original packaging, within a period of thirty (30) clear days from the date of receipt of the order. Before returning a Product, the Buyer must express his or her decision to retract the order by sending a return or exchange request by email to order@armogan.com. The request must be clearly formulated. A standard form is available on BWC’ website. Returned packages must be sent solely to the address indicated by BWC in the email order summary. In the event the package is not received by BWC, in the absence of proof of delivery by the postal service, the Product will not be reimbursed or exchanged and BWC cannot be held liable. All risk associated with the return of a Product shall be borne by the Buyer. The Buyer shall bear the costs of returning a Product to BWC, unless BWC agrees otherwise. BWC shall reimburse the Buyer all amounts paid for returned Product(s), including the initial delivery costs, if the Buyer returns the order in its entirety. Reimbursement shall occur through recrediting of the bank card or PayPal account used to place the order, within a maximum period of fourteen (14) days. If for some reason, the Buyer receives from BWC a Product that does not correspond to the Buyer's order, the Buyer is requested to contact BWC at order@armogan.com as soon as possible and in any case within fourteen (14) days following receipt of the Product so that BWC can confirm the irregularity and indicate the return procedure to be followed at BWC's expense.

IMPORTANT: For returns/exchanges from countries outside the EU, the Buyer must clearly indicate on the customs clearance waybill that the package is a non-commercial shipment with no market value, to ensure that no customs duties are charged to BWC. In the event of an exchange, BWC shall proceed likewise so that the Buyer does not have to pay customs duties a second time.

Article 11 - Warranties. All Products sold on the Website operated and managed by BWC benefit from the guarantee of conformity and the warranty against defects provided for by the Belgian Civil Code. To rely on this warranty, the Buyer must possess an invoice or receipt. In the event of a defect, the Buyer is obliged to inform BWC as soon as possible and in any case within two (2) months following discovery of the defect. The Buyer accepts that wear-and-tear to the bracelet and scratches on the glass do not constitute valid grounds for a claim.

Article 12 - Privacy and cookies. In accordance with the Act of 8 December 1993 on the protection of privacy, the Buyer has a right of access, rectification, objection and deletion with respect to the personal data relating to him or her that is kept by BWC.

Article 13 - Proof. The Buyer accepts that electronic communications and back-ups may be used to establish proof of a transaction between the Buyer and BWC.

Article 14 - Force majeure. BWC may not be held liable for total or partial non-fulfilment of its obligations under these General Conditions due to the occurrence of an event of force majeure such as (but not limited to) problems with the customs authorities, a strike, the bankruptcy of a third-party service provider used by BWC, non-delivery or late delivery of goods by BWC's external suppliers, trade restrictions or the imposition of new rules.

Article 15 - Governing law and jurisdiction. These abstracts are governed by Belgian law, regardless of the country of delivery, without prejudice to mandatory rules of law in the Buyer's country of residence. The Parties must first try to settle any disagreement they might have, but if they are unable to do so, any dispute regarding interpretation and/or performance must be brought before the competent courts determined in accordance with Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters. The Parties may also lodge a complaint via the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr/.
